01 Acceptance of These Terms
By accessing, browsing, registering for, subscribing to, or otherwise using Vipindi Kenya, you acknowledge that you have read, understood and agreed to be bound by these Terms of Use, together with any supplemental conditions expressly incorporated into them.
If you do not agree with these Terms, you must discontinue use of the service. Your continued access after a revised version becomes effective constitutes acceptance of that revised version, subject to any notice or consent requirement imposed by applicable law.
These Terms apply to access through browsers, mobile devices, compatible applications, streaming interfaces and other authorised means through which Vipindi Kenya may be made available.
02 The Vipindi Kenya Service
Vipindi Kenya is a digital entertainment service through which users may discover, browse and stream audiovisual programming. The service may include television programmes, drama series, films, short-form programming, live material, events, programme descriptions, artwork, recommendations, search functionality, player technology and related features.
The catalogue is dynamic rather than perpetual. Titles may be added, withdrawn, delayed, restricted, replaced, reclassified or otherwise modified as rights arrangements, contractual obligations, technical circumstances, editorial decisions or legal requirements change.

Vipindi Kenya may restrict, suspend or terminate access where reasonably necessary to protect the service, prevent abuse, investigate fraud, respond to security incidents, comply with law or enforce these Terms.
05 Subscriptions and Paid Access
Certain content or functionality may require payment or an active subscription. The commercial information displayed at the time of purchase, including price, duration, currency and applicable transaction conditions, forms part of the relevant purchase arrangement.
A subscription grants a limited right of access to the relevant service for the applicable period. It does not transfer ownership of the underlying content, artwork, software, trademarks, metadata or other intellectual property.
Access may cease or become restricted when a subscription expires, payment fails, a transaction is reversed, an account is suspended, a title becomes unavailable, or another legitimate restriction applies.
You must not defeat subscription checks, manipulate entitlement controls, obtain premium access without a valid entitlement, or use another person's restricted access for the purpose of circumventing payment or access controls.
For billing or payment issues, retain your transaction reference and contact Support with the relevant information so that the matter can be examined accurately.
06 Content, Viewing and Availability
Content provided through Vipindi Kenya is intended for personal entertainment unless the platform expressly states otherwise. Playback may depend upon device capability, network quality, bandwidth, browser behaviour, software configuration, geographical availability and third-party infrastructure.
Vipindi Kenya does not guarantee that every programme, episode, stream, artwork asset, metadata record or other item will remain available indefinitely. Availability may change because of licensing arrangements, contractual limitations, technical incidents, legal requirements, maintenance, security measures, editorial decisions or circumstances outside reasonable operational control.
Internet streaming is inherently dependent upon communications networks and infrastructure beyond the complete control of the platform. Accordingly, uninterrupted, instantaneous or error-free playback cannot be guaranteed at all times.
07 Acceptable Use and Prohibited Conduct
You must use Vipindi Kenya in a manner that preserves its legality, security, reliability and availability. Without limitation, you must not:
- circumvent, disable, probe, defeat or interfere with authentication, access-control or security mechanisms;
- scrape, harvest, systematically extract, mirror or republish substantial portions of the service without authorisation;
- deploy bots, crawlers, automated agents or scripts in a manner that bypasses intended interfaces or imposes unreasonable operational load;
- attempt to obtain another person's account, credentials, personal information or subscription entitlement without permission;
- transmit malicious code, malware, credential-stealing mechanisms or destructive payloads;
- impersonate another person, entity or representative of Vipindi Kenya;
- use the service to defraud, threaten, harass, intimidate or unlawfully target another person;
- interfere materially with the normal operation, availability or integrity of the service; or
- knowingly assist another person in carrying out a prohibited act.
A material breach of these requirements may result in restriction, suspension or termination of access where such action is reasonably necessary to protect users, rights holders, the platform or its infrastructure.
08 Intellectual Property
The Vipindi Kenya name, branding, logos, interface design, software, original text, compilation of catalogue information and other proprietary elements are protected by applicable intellectual-property law and remain the property of Vipindi Kenya, its licensors or the relevant rights holders.
Programme titles, audiovisual footage, artwork, characters, music, logos and associated materials may belong to third-party creators, studios, distributors, broadcasters or other rights holders. Access through Vipindi Kenya does not transfer ownership of those rights.
Except where expressly authorised or legally permitted, you must not reproduce, redistribute, commercially exploit, publicly perform, publicly display, sell, license or create derivative works from protected material obtained through the service.
09 Copyright Complaints and DMCA Reports
Vipindi Kenya recognises the importance of legitimate copyright ownership, licensing and rights administration. If you are a rights holder or an authorised representative and believe that material accessible through the service infringes rights that you are entitled to enforce, you may submit a copyright complaint through the designated reporting route.
An effective notice should identify the protected work, identify the material complained of with reasonable specificity, provide sufficient contact information, explain the basis of the complaint, and include any declarations or confirmations required by the applicable legal framework.

Third-party services may be governed by their own terms, privacy practices and operational policies. The presence of a third-party integration or link does not by itself constitute an endorsement of every aspect of that third-party service.
12 Security and Platform Integrity
Vipindi Kenya relies upon application logic, authentication, server infrastructure, network controls and other safeguards intended to preserve service integrity and availability.
You must not conduct or facilitate unauthorised penetration, vulnerability exploitation, credential attacks, denial-of-service activity, malicious traffic generation, access-control circumvention or other conduct intended to impair the service or obtain access that has not been legitimately granted.
Lawful security research conducted within the scope of an express written authorisation is distinct from unauthorised interference with production systems.
13 Maintenance, Modifications and Availability
Vipindi Kenya may modify, improve, restrict, suspend, replace or discontinue portions of the service where reasonably necessary for maintenance, security, technical migration, infrastructure changes, legal compliance, rights administration, product development or other legitimate operational purposes.
Scheduled and unscheduled maintenance may result in temporary interruptions. Although reasonable efforts may be undertaken to preserve continuity, uninterrupted availability cannot be guaranteed.
Material service changes may also result in updated information or revised Terms being published through the platform, subject to applicable legal requirements.
14 Suspension and Termination

15 Disclaimers
To the fullest extent permitted by applicable law, Vipindi Kenya is provided on an “as available” and “as is” basis. No representation is made that the service will always be uninterrupted, completely error-free, perfectly accurate, entirely secure or suitable for every particular purpose.
Programme descriptions, metadata, classifications, availability indicators and similar information may occasionally contain omissions, inaccuracies or delays. Reasonable efforts may be undertaken to correct material issues once identified.
Nothing in these Terms is intended to exclude a warranty, statutory right or consumer protection that applicable law prohibits from being excluded.
16 Limitation of Liability
To the fullest extent permitted by applicable law, Vipindi Kenya and its applicable officers, personnel, contractors, licensors and service providers shall not be liable for indirect, incidental, special, exemplary, consequential or punitive losses arising from or relating to use of, or inability to use, the service.
Such circumstances may include temporary unavailability, network interruption, device failure, third-party infrastructure, or other circumstances beyond reasonable operational control, subject to rights and liabilities that cannot legally be limited.
17 Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, liabilities, losses, costs or reasonable expenses arising from your material breach of these Terms, unlawful use of the service, infringement of another person's rights or misuse of an account or platform functionality.
This provision is not intended to require an indemnity beyond what is legally enforceable or to deprive you of a protection that cannot lawfully be waived.
18 Privacy and Personal Information
Your interaction with Vipindi Kenya may involve processing of information necessary to authenticate accounts, provide requested functionality, administer subscriptions, maintain security, troubleshoot incidents and operate the service.

21 Severability and Waiver

A failure to exercise or enforce a right immediately does not constitute a permanent waiver of that right or of the right to enforce the same provision later.

You may not assign, transfer, delegate or otherwise dispose of your rights or obligations under these Terms in a manner that compromises account integrity, subscription controls or the intended operation of the service without appropriate authorisation.
Vipindi Kenya may reorganise, restructure, transfer operational functions or assign applicable rights and obligations where reasonably necessary for continued service operation, subject to applicable law.
23 Entire Agreement
These Terms, together with policies, notices and transaction- specific conditions expressly incorporated into them, form the principal contractual framework governing use of Vipindi Kenya.
Additional conditions may apply to particular features, promotions, purchases, events or other services. Where such conditions are presented as part of the relevant transaction, they supplement these Terms for that specific purpose.
24 Changes to These Terms
Vipindi Kenya may revise these Terms when reasonably necessary to reflect changes in the service, legal developments, operational practices, security requirements or other legitimate considerations.
The “Last updated” date displayed at the beginning of this page identifies the latest published revision. Users should review this page periodically to remain informed of the provisions governing continued use of the service.
Where a material revision requires a specific form of notice or consent under applicable law, Vipindi Kenya will follow the applicable requirement.
